Text messages are a common means of communication among private subscribers although businesses are coming up rapidly to reap from the service. When the send text message service between business and mobile phone subscribers became evident, there was a need for short message gateways to control the resultant traffic. The main reason why the gateways were established was also to carry critical mission messages, for entertainment and for content delivery. Media agenda voting especially on radio and television heavily depends on this service to know more about the audience opinions. The gateway providers are categorized as mobile phone aggregators.

Different countries have varying legislations when it comes to information and communication and they have to be respected. For that reason, to send text message can make it be availed in court as a source of evidence against communication related crimes.

Sexist text messages have also been evident on many mobile phone subscribers resort to remain immoral. As they send text message that provoke sexual biology, whether it is moral or legal implication depends on the recipient of the message. This may be a legal insinuation when such a message targets another person's spouse, workmate and so on.

Immoral activities have also come up over the text messaging service such as the use of a sexist language. Although this depends on the type of recipient, it can be considered both a moral and legal decadence when you send text message with much sensational information over the mobile phone. Others have crossed the boundaries by extending such texts to people's spouses and workmates. Although it was possible to carry out criminal tasks over text messages, this is an idea that has till then vanished. By encrypting technology, the fortress program started in 2003 would effectively track messages that were alarming by aid of Symbian supported cell phones.

The program can retrieve deleted text messages irrespective of the time elapsed. This program is commonly used by crime investigators and in the light of this argument; a confessed murder was easily convicted on evidence retrieved from deleted message texts. Sara Syon in Sweden confessed as a murder of a pastor's wife and also admitted that the process was initiated through anonymous text messages to pastor Fossmo Helge's wife, Linde Knutby. Another court in Malaysia ruled that it was illegal to issue a divorce through text messages.
